Refusal to provide a breath sample, urine sample or blood sample will immediately result in a license suspension because South Carolina is an implied-consent state. There are challenges to this initial suspension which can be done at an administrative hearing. The administrative hearing is a hearing which is separate from the criminal penalties of DUI/DUAC and relates specifically to the suspension period that is imposed at the initial arrest.
